Rental and Purchase Terms and Conditions for Æventyr1 AS
1. General
1.1 These terms and conditions apply to the rental and purchase of winter clothing and equipment ("Items") from Æventyr1 AS ("the Company") located at Markedsgata 6, 9510 Alta, Norway.
1.2 By renting or purchasing Items from the Company, the customer ("Customer") agrees to these terms and conditions in their entirety.
1.3 The Customer agrees to these terms when placing an order on the Company's website.
2. Definition of Parties
2.1 The Renter or Seller is Æventyr1 AS and will hereafter be referred to as "we", "us", "the Company", or "Æventyr1".
2.2 The Renter is the person specified as the renter or buyer in the order and will hereafter be referred to as "the renter", "the customer", "you", or "your".
2.3 "Rental Items" include tools, equipment, machines, and everything else rented on Æventyr1's website.
2.4 "Delivery Method/Service Points" refer to delivery or return at a store, kiosk, or home delivery.
3. Payment, Deposit, and Prices
3.1 Payment occurs via Visa or Mastercard online through our payment provider DIBS, which meets the strictest security requirements. The rental agreement is considered entered into when the Renter pays at the time of ordering.
3.2 A flat deposit fee of 500kr is required for all rentals, to be paid at the time of ordering on the website along with the rental fee.
3.3 The deposit will be returned to the Customer upon return of the Items in good condition. The Company reserves the right to withhold part or all of the deposit to cover damages, late returns, or other breaches of these terms.
3.4 All prices include value-added tax (VAT). The total cost of the purchase will appear before ordering and include all expenses associated with rental or purchase.
3.5 In case of significant pricing errors on the Company's part, the Company can unilaterally change, delete or reject orders even after the customer has received an order confirmation or similar. However, such errors must be corrected and informed to the customer within a reasonable time after the error is discovered.
4. Condition of Rental Items
4.1 The Company undertakes to deliver high-quality Rental Items in operational condition. The Company has its own routines that check and maintain the Rental Items before and after rental.
4.2 During the rental period, you are responsible for any damage or loss to the equipment. Exemption from liability may occur if the damage or loss is due to technical faults or defects. The Renter is therefore obliged to check the Rental Item before use and contact the Company if the Rental Item is not in the expected condition.
5. Damages
5.1 All damages, technical faults, or accidents that may occur during the rental period must be reported to the Company immediately at support@aeventyr1.no. This also applies in case of theft.
5.2 If damage occurs due to misuse, intentional acts, or negligence, the Company may use the pre-reserved deposit and, if necessary, deduct additional outstanding amounts to cover the costs associated with repair, service, or replacement of the Item. This also applies if the equipment is returned in a poorly maintained state or returned dirtier than normal.
5.3 The Company always strives to provide the best advice and tips for using the Rental Item but is not responsible for execution or for direct or indirect damages or losses due to the use of the Rental Item, delays, or faults with the Rental Item.
6. Use of Rental Items
6.1 Use of Rental Items is at your own risk. The user must be over 18 years old.
6.2 The Renter is responsible for ensuring that equipment and accessories are used in such a way that they are not damaged or unreasonably soiled. Correct and safe use of the equipment is the Renter's responsibility. The Company facilitates the correct use of the equipment by making user manuals, instructions, and safety procedures available with the tool and/or on the Company's website. It is the customer's responsibility to familiarize themselves with the Company's usage and safety routines before using the equipment.
6.3 We recommend the use of protective equipment. You must also follow the equipment's user manual and other instructions from the Company.
7. Accessories
7.1 Accessories must, as a main rule, be purchased or rented separately when ordering the tool and are selected according to which task the renter wishes to perform on the website. The website also describes what is included in the delivery of the Rental Item. In addition, safety equipment is required in many situations and is offered on the website.
7.2 Accessories that are personal (dust masks, etc.) or consumables that wear out (saw blades, etc.) are not rented out. For accessories that are sold and have not been used, Section 12 Right of Withdrawal applies.
8. Renter's Rights and Obligations
8.1 The Renter must be 18 years of age or older and is obliged to provide correct customer details when creating a user account to be able to order and rent on aeventyr1.no. The Company sends messages to the specified email, address, and telephone, and such messages are considered received and valid upon dispatch from us.
8.2 The user account is personal, and if you suspect that others have access to your account, you are obliged to notify the Company immediately. The Company has the right to freely reject, terminate, or suspend user accounts without notice or liability, including if the terms are considered violated.
8.3 These rental terms must be accepted before ordering on the website.
8.4 The Renter must return the Rental Item before the agreed date and time expires and using the agreed delivery method. The Renter is expected to keep updated on the service point's normal opening hours.
8.5 The Renter or cardholder authorizes the Company to create credit card instructions for, among other things, Rental Items that are not returned, are dirtier than normal, or damaged. The authorization given also includes the authority to charge the payment card for additional rent/claims for compensation if the Rental Item is returned after the expiry of the agreed rental period or returned with faults or defects.
8.6 A delay in returning the tool beyond 1 - one - hour in relation to the agreed rental period entitles the Company to one day's extra rent as well as an addition, currently 300 NOK, which covers additional expenses the Company has for late return. If the Rental Item is not returned after one day, the Company is entitled to be compensated for the agreed daily price for as long as the tool is actually disposed of and not returned by the Renter.
9. Order Changes
9.1 To change an order, the Company must be contacted. Changes will not be valid until they are confirmed in writing by us. This is to ensure that the Rental Items are actually available. Unless otherwise agreed and confirmed, the Rental Item must be returned at the agreed time. Extension of the rental period can happen before the start of the rental period and/or during the rental period by changing the rental start or end.
9.2 Changes and cancellations of Rental Items that result in changes to the availability of the Rental Items for other users may be associated with a change fee to cover rebooking costs. The change fee is currently 300 NOK. All costs will be disclosed to the Renter before order placement or order change.
10. Delivery and Return
10.1 Delivery and return take place in the manner, at the place, and at the time specified in the order confirmation. You can also find it under your page. We are responsible for the products until they are taken over by you, i.e., when you have the products in your possession. To have the Rental Item delivered, you must have your booking reference. The name you specify on the reservation must match the name on the ID card at pick-up.
10.2 If the delivery of the Rental Items is delayed, we will provide you with information as soon as we have knowledge of it, along with information about when delivery may take place, or if the product(s) are sold out or the Rental Item(s) are not available.
10.3 You are responsible for the product until it is returned to us or our service points.
10.4 We check the condition and function of the Rental Items and that all parts are present when they arrive at our warehouse. Upon complete delivery in contractual condition, the reservation for the deposit on the payment card is deleted.
11. Right of Withdrawal on Purchases
11.1 The Cancellation Act gives you the right to cancel your purchases. The right of withdrawal applies to goods that are purchased and not to Rental Items. The right of withdrawal presupposes that you notify us no later than 14 days after receiving the delivery (See the Cancellation Act [https://lovdata.no/dokument/NL/lov/2014-06-20-27](https://lovdata.no/dokument/NL/lov/2014-06-20-27)).
11.2 To exercise the right of withdrawal, the product must be delivered to us in approximately the same quantity and condition as you received it. If you try, use, or examine the goods (open packaging, etc.) in a way that goes beyond what is necessary to determine the nature, properties, and function of the goods and this causes the goods to decrease in value, we can deduct an amount corresponding to the reduction in value from the purchase price to be refunded. For example, if you try on a dust mask, saw with a saw blade, or drill a hole with a drill bit, the right of withdrawal does not apply.
11.3 The product must be returned to us in the original packaging and within a reasonable time, together with the withdrawal form. The easiest way is to return the item in the same box as when you return the Rental Item. Then there are no costs for you. Fill out the withdrawal form and put it in the box. If you choose to send it back by mail or other methods, it is your responsibility until the item has arrived at us. You must provide your own suitable packaging and contact us before shipping.
12. Intellectual Property Rights
The content and service are protected by the Copyright Act. Visual material stored on the site is obtained with permission from rights holders. Videos on YouTube are links to third-party services outside the Company's control.
13. Privacy
13.1 The Company processes your personal information in a secure data register to fulfill its obligations and safeguard its rights in accordance with the rental agreement. The personal data processed are name, address, telephone number, e-mail address, and order history. This history will remain stored for accounting and other obligations. All stored information is available at "My Account". The Renter has the right to have their personal data removed from the Company's systems, which is done by personal inquiry to the Company.
13.2 Your payment card will be stored as long as you have an active order. The payment card is stored with our payment provider DIBS. They store the information in a secure and responsible manner. Storing the payment card makes it even easier when you shop. You can delete payment cards on your page. The Company does not store any credit card details itself.
13.3 The Company uses cookies, like most other online stores. Cookies store data in your browser so that the website can recognize you from page to page and visit to visit. We can then recognize who you are so that you can get the right prices and easier login, among other things. We also collect usage information to improve the quality of the service.

14. Governing Law
These terms are subject to and shall be interpreted in accordance with Norwegian law. The agreed legal venue is Oslo District Court.
15. Changes
15.1 The Company reserves the right at any time to change or replace these terms. The current terms are always available at aeventyr1.no. If the Company considers that the changes in the terms are significant in relation to the Renter's rights or obligations, the changes will be made available at aeventyr1.no 30 days before they take effect.
15.2 By using the service after the changes to the terms have been made available at aeventyr1.no, you agree to be bound by the updated terms. If you do not wish to accept the new terms, you cannot use Æventyr1.
By placing an order on the Company's website, the Customer acknowledges that they have read, understand, and agree to be bound by these terms and conditions.
